By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. Use of Service
Optimiz provides image optimization services. You are responsible for the images you upload and ensuring you have the necessary rights to use and modify them. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
You agree not to use the service for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Service in any way that could damage the Service, the reputation of Optimiz, or the general business of Optimiz.
3. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Optimiz and its licensors.
4. User Content
You retain all rights to any images or content you submit, post or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such User Content in connection with providing the Service. We do not store your images beyond the processing time required for optimization and offering them for download.
5. Limitation Of Liability
In no event shall Optimiz, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
6. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
